Liability Insurance

Four key products for businesses and individuals: carrier liability, freight forwarder’s liability, professional indemnity, and homeowners’ liability. We briefly explain the purpose, scope of cover, and where declinature risks most often arise.

Sections:#liability

Motor Carrier Liability (MTPL for carriers / CMR)

Protection of the carrier against claims from cargo owners and third parties. This is not cargo insurance but coverage of the carrier’s legal liability under contract and law.

B2BTransportCMR

Who needs it

  • Truck owners and fleet operators
  • Transport companies with regular routes
  • Carriers transporting high-value or scarce goods (high claims exposure)
  • Carriers operating internationally (CMR)

Key questions

Why if cargo is insured?
Cargo insurance protects the cargo owner. You need a policy that protects the carrier against liability claims.
Theft together with the vehicle?
May be covered subject to conditions (secured parking/seals/alarm systems). We verify these warranties before placement.
Valid outside Georgia?
CMR applies to international carriage (Russia/Europe/Turkey, etc.), but territorial scope depends on the insurance program.
Overloading and accidents—covered?
May lead to declinature if overloading is expressly excluded. We review policy wording in advance.
Limit: EUR 500k or 1m?
Limits are set based on cargo values and maximum foreseeable exposure. For high-value goods, EUR 1m may be insufficient.

Critical: compliance with parking/security warranties, seals, and operational conditions often has a greater impact on claims than the premium level.

Role of the Broker

  • We review exclusions and declinature conditions (secured parking, documentation, notification deadlines).
  • We structure limits based on actual exposure (not “market standard”).
  • We assist with claims handling: what evidence to collect and how to interact with the insurer.

Freight Forwarder’s Liability

For companies arranging transportation and documentation without always performing carriage themselves. Covers risks of subcontractor selection and errors in logistics or documentation.

B2BLogistics3PL

Who needs it

  • Freight forwarders and 3PL operators
  • Logistics companies using subcontracted carriers
  • Importers/exporters with regular shipments
  • Companies with extensive documentation workflows (declarations, invoices, mandates)

Key questions

If a subcontracted driver carries the goods—what am I liable for?
Typically for selection of subcontractors, documentation, and operational decisions (liability attaches where the error occurs).
Errors in declarations—are fines covered?
Extensions may be available, but fines/penalties are often excluded. We verify actual coverage in advance.
Rerouting/delay—who pays?
If a forwarder’s error causes a client’s loss, a claim may arise. Coverage for such scenarios is essential.
Consequential losses?
Depends on wording: loss of profit and business interruption are often excluded or require specific endorsements.
Broker value?
We structure cover to close liability gaps between shipper, forwarder, and performing carrier.

Common issue: clients assume “everything is covered,” while fines, penalties, and consequential losses are excluded. We identify this before binding.

Role of the Broker

  • We review exclusions and declinature conditions (secured parking, documentation, notification deadlines).
  • We structure limits based on actual exposure (not “market standard”).
  • We assist with claims handling: what evidence to collect and how to interact with the insurer.

Professional Indemnity (PI)

Protection against claims arising from professional negligence, errors, or omissions—from advisory services to projects and IT services. Often includes defence costs.

B2B/B2CLegal defenceRetro

Who needs it

  • Medical practitioners and clinics
  • Lawyers, accountants, auditors
  • Architects, engineers, designers
  • IT specialists and companies (development/implementation/outsourcing)

Key questions

What constitutes a claim?
Negligence, error, or omission in the course of professional services (as defined in the policy).
Are defence costs included?
Often yes: legal fees and expert costs are a key component of PI policies.
Retroactive period?
If included, the policy may respond to prior acts discovered later.
Pre-litigation support?
Strong programs include assistance and attempts to settle before litigation.
Why a broker?
Each profession has specific wordings. We know which markets are stronger for IT, healthcare, etc., and how to avoid coverage gaps.

Large clients often require PI with specified limits and retroactive dates. We align the policy with contractual requirements.

Role of the Broker

  • We review exclusions and declinature conditions (secured parking, documentation, notification deadlines).
  • We structure limits based on actual exposure (not “market standard”).
  • We assist with claims handling: what evidence to collect and how to interact with the insurer.

Homeowners’ Liability (Third-Party Liability)

Protection against expenses if you accidentally cause damage to neighbors: water damage, fire, gas explosion, or damage to common property.

RetailRentalNeighbors

Who it suits

  • Apartment owners
  • Landlords (rented properties)
  • Households with renovations and high-value interiors
  • Those who want simple annual coverage for liability risks

Key questions

Water damage to neighbors—what to do?
Take photos/videos, obtain a building report, record contacts, notify the broker immediately—we guide the process step by step.
Damage caused by tenants—covered?
Depends on wording; may require an extension. We tailor cover for rental scenarios.
Fire/gas explosion—common areas included?
May be covered as third-party and common property damage, subject to terms.
Limit for high-end renovations?
Standard limits may be insufficient. We set limits based on actual exposure in the building.
Price—why is it efficient?
An annual policy often costs less than a single emergency repair. It is low-cost protection against high-severity loss.

Important: claims depend on proper loss documentation (reports, photos, dates) and timely notification. This is where a broker adds tangible value.
